1. Description of Service

Podcastify is an artificial intelligence platform that transforms multimodal content (including text, PDFs, images, and websites) into podcast-style audio conversations. The Service utilizes proprietary processing and third-party generative AI services (including but not limited to Google, OpenAI, and ElevenLabs) to generate text transcripts and synthesize audio.

2. User Accounts

• Registration: You must create an account to use Podcastify. You agree to provide accurate, complete, and updated information.
• Security: You are responsible for safeguarding your account credentials. You must immediately notify us of any unauthorized use of your account.

3. Intellectual Property and Content Rights

3.2 Generated Output and Commercial Use

Podcastify claims no ownership rights over the transcripts or audio files generated from your Input Content ("Generated Output").

• Commercial Rights: Subject to your compliance with these Terms, Podcastify grants you full rights to use, distribute, monetize, and exploit the Generated Output for both personal and commercial purposes.
• Attribution: While not strictly required, you may not misrepresent the Generated Output as entirely human-created if prohibited by the terms of the underlying AI providers or applicable laws.

4. Acceptable Use Policy

You agree not to use Podcastify to:

• Process illicit, illegal, highly restricted, or non-consensual explicit content.
• Generate audio that impersonates real individuals without their explicit consent or attempts to create deepfakes intended to deceive.
• Generate hate speech, harassment, or content that promotes violence.
• Attempt to reverse-engineer, scrape, or disrupt the backend infrastructure, including our FastAPI endpoints, Celery workers, or Supabase databases.

5. Third-Party AI Providers

Podcastify relies on third-party AI models (e.g., Gemini, OpenAI, ElevenLabs, Edge TTS) to generate transcripts and audio. By using Podcastify, you acknowledge that your Input Content may be processed by these third-party services. Your use of Podcastify is also subject to the Acceptable Use Policies of these respective providers.

6. Subscriptions and Payments

• Fees: Use of certain features on Podcastify requires a paid subscription. All fees are stated in $US and are non-refundable unless otherwise specified by law or our refund policy.
• Cancellation: You may cancel your subscription at any time. Your access will remain active until the end of your current billing cycle.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Due to the nature of machine learning and generative AI, Podcastify does not guarantee that the transcripts or generated audio will be entirely accurate, error-free, or perfectly aligned with the Input Content. You are responsible for reviewing all Generated Output before publishing or distributing it.

8. Limitation of Liability

To the maximum extent permitted by law, Podcastify and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from (a) your use or inability to use the Service; (b) any unauthorized access to our servers (including our Supabase storage); or (c) any generated content.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

10. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you by updating the date at the top of these Terms and, when appropriate, by sending an email or displaying a notice within the platform.
